1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the QuizNap platform, operated by Aiistic ("we," "our," or "us"), including our website at quiznap.com, APIs, SDKs, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To use most features of the Service, you must create an account. You agree to:

• •Promptly notify us of any unauthorized use of your account
• •Accept responsibility for all activity under your account

3. Permitted Use

You may use the Service to create, distribute, and analyze quizzes, surveys, forms, and assessments for lawful purposes. You agree not to:

• •Collect sensitive personal data (health, financial, etc.) without proper consent and safeguards
• •Distribute spam, phishing, or malicious content through quizzes
• •Attempt to reverse-engineer, decompile, or hack the Service
• •Interfere with or disrupt the Service's infrastructure
• •Resell access to the Service without our written permission

4. Your Content

You retain ownership of all content you create through the Service, including quiz questions, branding assets, and configuration ("Your Content"). By using the Service, you grant us a limited license to host, store, process, and display Your Content solely to provide the Service to you.

You are solely responsible for Your Content and ensuring it does not violate any third-party rights or applicable laws. We reserve the right to remove content that violates these Terms.

5. Respondent Data

When respondents submit answers to your quizzes, you are the data controller for that respondent data. You are responsible for providing appropriate privacy notices to respondents, obtaining any necessary consent, complying with applicable data protection laws (GDPR, CCPA, etc.), and responding to respondent data requests. We act as a data processor on your behalf and process respondent data only as directed by you through the Service.

6. Plans & Payment

The Service offers free and paid plans. Paid plans are billed monthly or annually as selected at the time of purchase. You agree to pay all fees associated with your chosen plan.

• •You may cancel at any time; cancellation takes effect at the end of the current billing period
• •Refunds are provided at our discretion for annual plans within 14 days of purchase
• •Exceeding plan limits may result in restricted functionality until you upgrade

7. Integrations & Third-Party Services

The Service may integrate with third-party services (Google Sheets, Slack, etc.). Your use of such integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or practices of third-party services. You authorize us to share data with integrated services as configured by you.

8. Intellectual Property

The Service, including its design, code, logos, trademarks, and documentation, is owned by Aiistic and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets without prior written consent. The QuizNap SDK packages are provided under the terms specified in their respective LICENSE files.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIISTIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your account if you violate these Terms, with or without notice. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service at least 30 days before they take effect. Your continued use after changes constitutes acceptance.
